Wakey ("Wakey", "we", "us", or "our") operates this store and website, including all related information, content, features, tools, products and services, as well as the Wakey mobile app (the "App"), in order to provide you, the customer, with a curated shopping and wake-up experience (the "Services"). Our online store is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
For the purpose of applicable data protection law, including the EU General Data Protection Regulation (GDPR), the data controller of your personal information is Stackkicks (trading as Wakey), established at Pekstraat 2, 8211 AB Lelystad, the Netherlands.

Personal Information We Collect or Process

Personal information does not include information that is collected anonymously or that has been de-identified so that it cannot identify or be reasonably linked to you. Depending on how you interact with the Services, where you live, and as permitted or required by applicable law, we may collect or process the following categories of personal information, including inferences drawn from it:

- Financial information, including payment card information, financial account information, transaction details, form of payment, and payment confirmation. Card details are processed directly by our payment providers; we do not receive or store full card numbers.

- Transaction information, including the items you view, add to your cart or wishlist, or purchase, return, exchange or cancel, and your past transactions.
- Communications with us, including the information you provide when you contact customer support or leave a review.
- Device information, including information about your device, browser, or network connection, your IP address, and other unique identifiers.
- Usage information, including how and when you interact with or navigate the Services.
In addition, when you use the Wakey App, we may collect the categories of information described in the "Wakey Mobile App" section below.

Depending on how you interact with us and which Services you use, we may use personal information for the purposes below. Where the GDPR applies, the legal basis for each purpose is shown in brackets.
- Provide, tailor, and improve the Services. To perform our contract with you, process payments, fulfill and ship orders, manage your account, handle returns and exchanges, enable reviews, remember your preferences, and create a customized experience such as recommending related products. How We Disclose Personal Information
We do not sell your personal information. In certain circumstances we may disclose it to third parties for the legitimate purposes described in this Privacy Policy, including:
- With Shopify, vendors, and other service providers who perform services on our behalf, such as IT and hosting, payment processing, analytics, customer support, cloud storage, and fulfillment and shipping. These include Shopify (store hosting), Mollie and Stripe (payment processing), DHL (shipping and delivery), and Klaviyo (email and SMS communications).
- With business and marketing partners to provide marketing services and advertise to you, including advertising platforms used for measurement and remarketing, such as Meta (Facebook and Instagram), TikTok, and Google. These partners use your information in accordance with their own privacy notices.
- When you direct or consent to disclosure to third parties, for example to ship your products or when you use social media or login integrations.
- With our affiliates or otherwise within our corporate group.
- In connection with a business transaction such as a merger or acquisition, or to comply with legal obligations, enforce our terms, and protect our rights and the rights of others.
Wakey Mobile App
The Wakey App provides alarm and NFC-tag features. The practices below apply in addition to those described elsewhere in this Privacy Policy.
- Account information. You sign in to the App with Apple or with your email address. We receive your name, email address, and a user identifier in order to create and synchronize your account. Account data is stored securely with our backend hosting provider.
- Device and usage data. We collect device type, operating system, app version, and information about how you use the App and your Wakey NFC tags (for example, alarm and tag activity), to operate, secure, and improve the App.
- Notifications. With your permission, we use push notification tokens to send alarm, reminder, and account notifications.
- Approximate location. If you enable location-based features in the App (such as local weather), we use your approximate location only to provide those features. We do not use this location for advertising.
- Sharing. We do not sell your App data. We share it only with providers that help us operate the App (such as our backend hosting provider), who process it on our behalf. Data is encrypted in transit.
- Retention and deletion. You can request deletion of your account and associated App data at any time within the App's settings or by contacting us using the details below.
Relationship with Shopify
Our online store is hosted by Shopify, which collects and processes personal information about your access to and use of the store in order to provide and improve the Services. Information you submit may be transmitted to and shared with Shopify and third parties that may be located in countries other than where you reside. Shopify may also use certain enhanced features that incorporate data from your interactions with our store, other merchants, and Shopify. In those circumstances Shopify is responsible for the processing, including for responding to requests to exercise your rights. Cookies and Tracking Technologies
We use cookies and similar technologies (such as pixels and tags) to operate our website, remember your preferences, understand how the Services are used, and support marketing. We distinguish between:
- Strictly necessary cookies, required for the site and checkout to function.
- Analytics cookies, to measure and improve performance, such as Shopify Analytics.
- Marketing and advertising cookies, such as the Meta Pixel, used for measurement and remarketing.
In the EEA, we ask for your consent before placing non-essential cookies through our cookie banner, and you can change or withdraw your preferences at any time via the "Cookie preferences" link in the footer of our website. A full list of the cookies we use is available through our cookie banner.
Children's Data
The Services are not intended for children, and we do not knowingly collect personal information from children under the age of 16 (or the age of majority in your jurisdiction). If you are a parent or guardian and believe your child has provided us with personal information, please contact us using the details below and we will delete it.
Security and Retention of Your Information
No security measures are perfect or impenetrable, and we cannot guarantee "perfect security," nor can we guarantee that information is secure while in transit. We recommend not using unsecure channels to send us sensitive information.
How long we retain your personal information depends on factors such as whether we need it to provide the Services, maintain your account, comply with legal obligations (for example, the Dutch statutory retention period for invoicing data is generally 7 years), resolve disputes, and enforce our agreements. When information is no longer needed, we delete or anonymize it.
Your Rights and Choices
Depending on where you live, you may have some or all of the following rights regarding your personal information. These rights are not absolute and may apply only in certain circumstances.

We may need to verify your identity before responding, and we will respond within the time required by applicable law (within one month under the GDPR). You may authorize an agent to make a request on your behalf, subject to proof of authorization. We will not discriminate against you for exercising your rights.
International Transfers

Where we transfer personal information out of the European Economic Area, we rely on a recognized transfer mechanism — such as an adequacy decision, the EU-US Data Privacy Framework, or the European Commission's Standard Contractual Clauses (SCCs) — to ensure your information remains protected.
